VIRTUAL EVENT TERMS & CONDITIONS

These terms and conditions are deemed to incorporate our Privacy Policy.

These terms and conditions govern your relationship with us and Level Water relating to your registration and participation in any virtual event ("Event") operated by us or on behalf of Level Water. By registering for a virtual Event, attending, or participating in the Event, or purchasing related digital merchandise, you agree to these terms and conditions. These terms and conditions form a fundamental part of your participation.

1. DEFINITIONS & INTERPRETATIONS

  1. "Event" means a virtual swimming challenge or activity owned or operated by the Event Organisers, to be completed remotely by participants using their own facilities (e.g., local swimming pool or open water).

  2. "Entrant" means any individual who registers and participates in the virtual Event.

  3. "Online Registration" refers to the digital platform where participants register to take part in the Event.

  4. "Online Confirmation" is the email confirming your registration and participation in the Event.

  5. "Platform Fee" refers to the charge by the registration provider.

  6. "Ticket" means confirmation of registration entitling the Entrant to participate in the virtual Event.

  7. "We", "us", "our" and "Event Organiser" refer to Level Water or its appointed agents.

  8. "You" and "your" refer to the individual entering the Event.

2. REGISTRATION

2.1 You must be aged 18 or older to register, unless otherwise stated.

2.2 You must ensure that the registration information you provide is complete and accurate. Any changes must be updated via the registration platform.

2.3 You confirm that you are fit and able to complete the swim challenge and understand all associated risks.

2.4 All Entrants must sign a digital disclaimer prior to participating. You swim entirely at your own risk.

3. TICKETS & PAYMENT

3.1 All Tickets are subject to availability.

3.2 Payment includes the Entry Fee and a non-refundable Platform Fee.

3.3 Tickets are non-transferable unless expressly permitted via the registration platform.

3.4 No refunds will be provided unless explicitly stated in clause 5.

4. EVENT PARTICIPATION & SAFETY

4.1 The Event is self-managed. You are responsible for completing the challenge safely at your chosen time and location.

4.2 You must ensure your location is safe, legal, and appropriate for swimming.

4.3 You confirm you are sufficiently fit and healthy to participate. Medical advice should be sought if unsure.

4.4 The Event Organiser accepts no responsibility for accidents, injuries, or issues arising from your participation.

4.5 No drugs, alcohol or performance-enhancing substances may be used.

5. EVENT CHANGES & CANCELLATION

5.0 The Event is virtual and runs from Sunday 1st June 2025 to Monday 30th June 2025.

5.1 The Event Organiser may make changes to the Event as necessary.

5.2 As the Event is virtual and flexible, cancellation is unlikely. If technical or other issues require it, the Event may be suspended or closed early.

5.3 Refunds are at the sole discretion of the Event Organiser (excluding Platform Fees).

5.4 You are responsible for any costs incurred for equipment, access, or other participation-related items.

6. MEDIA & CONTENT

6.1 The Event may include options for submitting photos or videos.

6.2 By submitting content, you grant us a perpetual, royalty-free licence to use it for marketing or promotional purposes.

6.3 You may request not to be featured in promotional materials by notifying us in advance.

6.4 Personal recordings are permitted for non-commercial use only.

7. LIABILITY

7.1 Participation is at your own risk. You are responsible for your own safety, wellbeing, and compliance with laws.

7.2 The Event Organiser accepts no liability for loss, damage, injury, or death arising from participation.

7.3 You agree to indemnify the Event Organiser from claims arising from your participation.

8. DATA & PRIVACY

8.1 Your data will be processed in accordance with our Privacy Policy.

8.2 Health data is collected during registration with your consent and used for safety purposes only.

8.3 Anonymised data may be used for statistical or commercial reporting.

9. GENERAL

9.1 These terms and conditions are subject to English law.

9.2 Any dispute shall be resolved in the English courts.

9.3 If any clause is found unenforceable, the remainder shall remain in force.

9.4 We may amend these terms with notice if changes materially affect your rights.

9.5 No third party shall have any right to enforce these terms under the Contracts (Rights of Third Parties) Act 1999.

9.6 All participants will receive a complimentary swim hat upon registration.

9.7 Participants who raise £100 or more will receive a complimentary t-shirt and medal as a thank you for their fundraising.

9.8 No additional incentives (beyond the swim hat) will be sent unless the £100 fundraising target is reached.

9.9 You should receive your sign-up incentive and your £100 fundraising target incentives within 10 working days of reaching each milestone, subject to delivery conditions.

9.10 While we aim to dispatch incentives within 10 working days, any delays due to stock or supply issues will be communicated to you as soon as possible.

9.11 Incentives will only be delivered to UK addresses.

9.12 Incentives are non-exchangeable and non-transferable. No cash alternatives will be offered.
